Who can use the Service

You must be at least 18 years old and authorised to act on behalf of the gym or business you register. You are responsible for keeping your login credentials secure and for all activity under your account.

The Service

GymNudge helps gym owners track attendance and renewals, flag inactive members, and follow up with members. GymNudge focuses on retention and is designed to run alongside other tools you may use. Features and plans may change over time.

Your data and your responsibilities

• You own the data you enter into GymNudge, including your member records.
• You are responsible for having a lawful basis and any necessary consent to add your members' personal information to the Service.
• You agree to keep your data accurate and to use the Service lawfully.
• We process your data in line with our Privacy Policy.

Acceptable use

• Do not use the Service for any unlawful purpose or to send spam or harassing messages.
• Do not attempt to reverse engineer, copy, resell, or disrupt the Service.
• Do not try to access other gyms' data or bypass security or tenant isolation.

Subscriptions, billing, and trials

Paid plans are billed in advance on a monthly or annual basis in Indian Rupees. All prices exclude GST, which is charged where applicable. Each subscription covers one gym branch. Unless stated otherwise, fees are non-refundable. We may change standard pricing with reasonable notice; changes apply from your next billing cycle. If a free trial or pilot is offered, we will let you know before it ends, and we will not begin charging you without your confirmation.

Annual billing saves you about two months versus paying monthly. Optional add-ons and third-party services are billed separately and are not included in your subscription. You can cancel anytime; your plan stays active until the end of the period you have paid for.

Founding pricing

Founding pricing is an early-adopter rate. Your founding subscription price stays locked as long as your subscription remains continuously active, even after our standard prices rise. If your subscription lapses or is cancelled, re-subscribing is at the then-current standard price.

Messaging and payment charges

WhatsApp messaging is subject to plan limits, fair usage, or any charges levied by WhatsApp or your messaging provider. GymNudge is not a payment gateway; any payment gateway, UPI, or bank transaction charges are not included in your subscription and are payable to the relevant provider.

Your data

You own the data you enter into GymNudge. You can request a full export of your data at any time, and we will provide it within a reasonable period.

Third-party services

The Service may rely on or link to third-party services, such as WhatsApp for follow-up. Your use of those services is subject to their own terms, and we are not responsible for them.

Intellectual property

GymNudge and its software, branding, and content are owned by us. These Terms do not give you any ownership of the Service itself; you receive a limited right to use it while your account is active.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error free, or that it will achieve any particular retention or business result.

Limitation of liability

To the maximum extent permitted by law, GymNudge will not be liable for any indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the claim.

Termination

You may stop using the Service and close your account at any time. We may suspend or end your access if you breach these Terms or use the Service in a way that risks harm to others or to the Service.

Governing law

These Terms are governed by the laws of India, and you agree to the exclusive jurisdiction of the courts in India for any dispute relating to the Service.

Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date above, and continued use of the Service after changes means you accept the updated Terms.
